Justice Dery insisted that he was not informed about Tuesday’s hearing and “thus breached his right to be heard.” He also added that all the four persons cited in the contempt case have not yet been served with the said application and that “the judge [also] erred when she dismissed the Appellant’s Contempt Application on the ground that the Appellant had withdrawn his Interlocutory Injunction Application.” Justice Dery is praying the court to reverse the decision of the earlier ruling. Mr. Dery had prayed the court presided over by Justice Gertrude Torkonoo to convict and punish the Chief Executive Officer of Starr FM,[Bola Ray], the Acting Editor-In-Chief of the New Crusading Guide, Samuel Frempong Addo, Deputy Editor of the New Crusading Guide, Ernest Addo and the Executive Director of the Media Foundation for West Africa (MFWA), Sulemana Braimah.
