
Mr. Alhassan Abubakari, 26years old and unemployed (accused) has been accused of assaulting one Mr. Enoch Yirbie, a staff of VRA/NEDCO, Kaleo in the Upper West Region.
The accused was brought to court escorted by fully armed policemen numbering about 14.
The District Police Commander, the NIB, the District Immigration Service Commander and a National Security Officer were present in the courtroom.
According to the Police Prosecutor Mr. Solomon, the accused made unpalatable comment on a WhatsApp page “Friends of Ambrose Dery” which resulted in the removal of the accused from the page by the victim.
The accused is alleged to have threatened to beat victim.
The accused is alleged to have met the victim in Nandom Town on Monday, the 4th of September, 2023 and carried out his earlier threat (slap victim).
The victim filed a case of assault against the accused. The victim was given a medical form to go to the hospital for medical care.
The accused was arrested and put behind bars. The case was brought to the *Nandom District Magistrate Court* on September 5, 2023 and the charges read to the accused. The accused denied assaulting the victim.
In his defence, the counsel of the accused, Lawyer Iddrisu Munjamilu quoting relevant portions of the 1992 Constitution of Ghana and a ruling by the Supreme Court (Martin Kpebu v the Attorney General) appealed to the court to grant the accused bail pending trial.
The Counsel believes that the accused has no power to interfere with investigations. “The accused has not shown he’s capable of interfering with investigations.”
He explain that, “without prejudice to the substantive matter, it is evident that this case is a case of Political Vendetta”.
The accused stated that the charge presented against his client (accused) cannot be substantiated hence not reason enough for the accused to escape.
The Police Prosecutor objected to the bail request but the court granted the bail application.
The condition is Ghc20,000 with two sureties and to report to the Police Station every Friday.
